End User License Agreement (EULA)

These Terms of Use set forth the conditions for your access to and use of our installation utility and related software components (together, the "Installer" and the "Software"). By downloading, installing, or using the Software, you ("User," "you") agree to be bound by these Terms, which create a legally binding agreement between you and ProFile PDF ("Company," "we," "us," or "our").
Ownership & Scope
The Installer and Software are proprietary to the Company and/or its licensors. Your use of them is governed exclusively by these Terms, which apply to all features, modules, and functionalities that form part of the Installer and the Software.
User Agreement & Acceptance
By installing, accessing, or using the Software, you represent that you have read and understood these Terms and agree to comply with them, as well as with all applicable laws and regulations. If you do not agree with any provision of these Terms, you must immediately stop using the Software and remove it from your device.
To support proper functionality, stability, and performance, the Software may collect and process certain limited usage and technical data. We strongly recommend that you review our Privacy Policy before completing the installation.
Installer & Software Services
By initiating the installation process, you grant ProFile PDF permission to install the Software and any necessary supporting components on your device. As part of this process, and only with your prior consent, ProFile PDF may modify specific browser settings—such as your default search engine, home page, or new tab page—in order to connect you with a search provider chosen by us.
If, at a later time, you choose to uninstall ProFile PDF, your previous browser settings will not automatically be restored. You can, however, change them back at any time through your browser's settings or preferences menu.
By proceeding with the installation, you explicitly acknowledge and agree that ProFile PDF may be set as your default file conversion solution and that you accept all additional terms and conditions applicable to its features and functionality.
License & Usage Restrictions
Subject to your continued compliance with these Terms, the Company grants you a limited, non-exclusive, revocable, and non-transferable license to install and use the Software solely for your personal, non-commercial use.
All rights not expressly granted to you under these Terms are reserved by the Company and/or its licensors.
You are not permitted to:
- Use the Software for any commercial resale, redistribution, or similar exploitation.
- Transfer, assign, or sublicense the Software to any third party.
Third-Party Content
The Software may display or link to content, services, or features provided by third parties, including but not limited to advertisements, search tools, and external websites. The Company does not own or control such third-party resources and is not responsible for:
- Their availability or continued operation;
- The accuracy, legality, or quality of their content; or
- Any damages or consequences resulting from your use of them.
Your interaction with third-party content is at your own discretion and risk, and may be subject to the relevant third party's own terms and policies.
User Responsibilities
When using the Software, you agree that you will not:
- Copy, reproduce, distribute, rent, sell, or sublicense the Software or any portion of it.
- Modify, adapt, translate, reverse-engineer, decompile, or attempt to derive the source code of the Software, except where such actions are expressly permitted by applicable law.
- Bypass, disable, or otherwise interfere with security-related features or technical protections in the Software.
- Use the Software in any manner that is unlawful, fraudulent, harmful, or in violation of these Terms.
Any breach of these obligations may result in the immediate suspension or termination of your right to use the Software, and may expose you to civil and/or criminal liability.
Intellectual Property
All intellectual property rights in and to the Installer and Software—including, without limitation, trademarks, logos, design elements, text, graphics, code, and other proprietary components—are owned by the Company or its licensors.
Your use of the Software does not confer any ownership rights, title, or interest in any of these intellectual property assets. You are granted only the limited license described in these Terms.
Disclaimer of Warranties
The Software is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the Company disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to:
- Warranties of merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Availability, reliability, or error-free operation of the Software.
We do not guarantee that the Software will function without interruptions, that it will be compatible with every device or configuration, or that it will be free of defects, vulnerabilities, or technical issues. You assume all risks associated with installing and using the Software.
Limitation of Liability
To the maximum extent permitted under applicable law, the Company shall not be liable for any:
- Indirect, incidental, special, punitive, or consequential damages;
- Loss of profits, revenue, or data;
- Business interruption or loss of business opportunities
arising out of or in connection with your use of, or inability to use, the Software, even if the Company has been advised of the possibility of such damages.
In any event, the total aggregate liability of the Company for any and all claims related to the Software or these Terms shall be limited to the greater of: (i) USD $10, or (ii) the amount actually paid by you (if any) for the Software.
Software Updates & Modifications
From time to time, the Company may provide updates, patches, bug fixes, or new versions of the Software in order to improve functionality or security. Such updates may be installed automatically or may require your manual installation, depending on your device settings.
By using the Software, you consent to the receipt and installation of these updates. The Company shall not be responsible for any temporary interruptions, performance changes, or potential incompatibilities resulting from updates or modifications.
Termination of Agreement
These Terms remain in effect until terminated by either you or the Company.
You may terminate these Terms at any time by fully uninstalling and ceasing all use of the Software.
The Company may terminate or suspend your access to the Software immediately if you violate these Terms or if continued access poses a risk to the Company, other users, or third parties.
Upon termination, the license granted to you will automatically cease, and you must stop all use of the Software. Any continued use after termination will be considered unauthorized and a breach of these Terms.
Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Software;
- Your violation of these Terms; or
- Your infringement or violation of any third-party rights.
The Company reserves the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully with us in asserting any available defenses.
Modifications to These Terms
The Company may revise or update these Terms from time to time. Any changes will become effective once the updated version is made available (for example, via our website or within the Software).
Your continued use of the Software following the effective date of revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of the Software and uninstall it.
General Legal Provisions
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent authority, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
The Company's decision not to enforce any right or provision in these Terms shall not be deemed a waiver of such right or provision.
You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of the Company. Any unauthorized assignment shall be null and void.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Software shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv, Israel.
Any legal claim or cause of action must be filed within twelve (12) months from the date the claim first arose; otherwise, such claim or cause of action shall be permanently barred.
Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to events or circumstances beyond its reasonable control, including but not limited to:
- Natural disasters or extreme weather;
- Fire, flood, or explosion;
- War, terrorism, riots, or civil unrest;
- Power outages or telecommunications failures;
- Governmental acts, regulations, or restrictions.
In such cases, the Company's obligations will be suspended for the duration of the relevant event.
